Anëtarët e KOMF mbajtën punëtorinë dy ditore për vlerësimin e nevojave të KOMF dhe organizatave anëtare, për themelimin e Platformës për Pjesëmarrjen e Fëmijëve "MEGAFON". Kjo platformë do të fuqizojë pjesëmarrjen aktive të fëmijëve në procese vendimmarrëse, sidomos fëmijëve të cenueshëm. ![]()

Ky aktivitet realizohet në kuadër të ndërhyrjes nacionale "MEGAFON - Fuqizimi i zërit të fëmijëve dhe të rinjve në Kosovë”, mbështetur nga projekti rajonal SMART Balkans – Shoqëria Civile për Vlera të Përbashkët në Ballkanin Perëndimor të zbatuar nga Centar za promociju civilnog društva (CPCD) në bashkëpunim me Instituti për Demokraci dhe Ndërmjetësim (IDM), dhe Qendra për Kërkim dhe Politikëbërje (CRPM) dhe i mbështetur financiarisht nga Ministria e Punëve të Jashtme të Norvegjisë (NMFA).

Bazuar në vlerësimin e realizuar, mund të konstatohet se legjislacioni i sistemit të drejtësisë për të mitur në Kosovë, në masë të konsiderueshme, është i harmonizuar me kërkesat dhe standardet ndërkombëtare, duke ofruar një bazë të qëndrueshme për zbatimin praktik të parimit të “interesit më të mirë të fëmijës” përmes masave të diversitetit.![]()

Megjithatë, pavarësisht përparimeve në ndërtimin e këtij sistemi, vlerësimi ka identifikuar se zbatimi praktik i këtyre masave mbetet i kufizuar dhe nuk përputhet plotësisht me synimet e ligjvënësit dhe standardet ndërkombëtare. Të gjeturat e vlerësimit nxjerrin në pah një tendencë shqetësuese të rënies së vazhdueshme në përdorimin e masave të diversitetit, gjë që bie ndesh me frymën dhe objektivat e Kodit të Drejtësisë për të Mitur. Shqetësuese mbetet poashtu rritja e vazhdueshme e numrit të të miturve në konflikt me ligjin dhe përfshirja e të miturve në vepra të rënda penale. ![]()

Mungesa e qartësisë në interpretimin e dispozitave ligjore, dhe moszbatimi i masave të reja të përfshira në Kod dëshmojnë për një zbatim të fragmentuar dhe jo të qëndrueshëm të këtyre masave.![]()
Adresimi i këtyre sfidave është thelbësor për të garantuar që dispozitat përkatëse të Kodit të Drejtësisë për të Mitur që lidhen me masat e diversitetit, të zbatohen në mënyrë efektive.![]()

Kjo studim u mundësua në kuadër të projektit “Mbrojtja e fëmijëve të cenueshëm në Kosovë”, i cili mbështetet financiarisht nga European Union in Kosovo dhe implementohet nga Unicef Kosovo Programme, në bashkëpunim me Koalicionin e OJQ -ve për Mbrojtjen e Fëmijëve – KOMF.

📍Instalacioni kishte për qëllim ndërgjegjësimin e publikut për format e rënda të punës së fëmijëve dhe pasojat shkatërruese që ato sjellin në shëndetin dhe mirëqenien e tyre, si dhe të nxisë përgjegjësi institucionale, për të rritur vëmendjen dhe ndërmarrë veprime konkrete në drejtim të eliminimit të formave të rënda të punës së fëmijëve në Kosovë.![]()

Udhëzimi Administrativ për parandalimin dhe ndalimin e formave të rrezikshme të punës së fëmijëve në Kosovë përcakton listën e formave të rrezikshme të punës së fëmijëve, ku ndër to rradhiten: puna në ndërtimtari, puna në deponi të mbeturinave, puna në rrugë, puna në bujqësi dhe pylltari, etj. ![]()

☎️Çdo person ka obligim ligjor për të raportuar çdo informatë të pranuar në lidhje me dyshimin se një fëmijë është përfshirë në forma të rrezikshme të punës. Identifikimin dhe referimin mund ta bëjë edhe fëmija për fëmijën, si dhe fëmija për vetveten.![]()
Çdo person që identifikon një fëmijë që është në rrezik apo është viktimë e përfshirjes në njërën prej formave të rrezikshme të punës, duhet të njoftojë Policinë apo Qendrën për Punë Sociale. ![]()
